The high court has amended its decision not to hear ‘green’ cases and has clarified that it will continue to hear cases already pending before it, while new cases will be decided on a case-by-case basis. It was decided earlier that the high court will not hear 45 types of cases related to environmental issues, but would refer them to the National Green Tribunal’s (NGT) regional bench in Chennai.
Even as the high court’s decision on allowing a National Green Tribunal circuit bench here is pending, the court clarified on Wednesday that it would not hear 45 types of cases related to environmental issues. With the court adopting such a stance, litigants in these 45 types of cases will have to travel to Chennai for grievance redressal before the National Green Tribunal’s regional bench there, which is expected to drive up the cost of litigation significantly.
