Judgement of the Supreme Court of India in the matter of Cellular Opeators Association of India & Others Vs Telecom Regulatory Authority of India & Others dated 11/05/2016 regarding call drop compensation by telecom service providers.
Supreme Court upholds the contention of Cellular Operators' Association of India regarding the need to compensate consumers for call drops and said that a strict penal liability laid down on the erroneous basis that the fault is entirely with the service provider is manifestly arbitrary and unreasonable. Also, the payment of such penalty to a consumer who may himself be at fault, and which gives an unjustifiable windfall to such consumer, is also manifestly arbitrary and unreasonable.
