Judgement of the Supreme Court of India regarding Bus Rapid Transit System Corridor proposed to be developed by the Municipal Corporation, Bhopal, 29/11/2016
Judgement of the Supreme Court of India in the matter of Ravindra Ramchandra Waghmare Vs Indore Municipal Corporation & Ors. dated 29/11/2016 regarding Bus Rapid Transit System Corridor proposed to be developed by the Municipal Corporation, Bhopal on the stretch of around 8 kms. As per Bhopal Development Plan, 2005 which was notified in the year 1995, the proposed width of the road is 66 mtrs. The writ petitions were filed by the landowners 2014 questioning the action initiated by the Municipal Corporation on the ground that such an action was impermissible under the provisions of section 305 of the Act of 1956.
Supreme Court in its Judgement says that compensation has to be awarded within a 'reasonable time' and said that Law envisages speedy action without unreasonable delay and that is what is expected of the concerned authorities, in respect of the obligation imposed on them to be discharged.
