Order of the Supreme Court of India in the matter of Manali Hoteliers Association Vs Ramesh Chand & Others dated 05/03/2018 regarding hotel, lodges, home stays operating without consent of the State Pollution Control Board and flouting environmental laws in Manali, Himachal Pradesh. Manali Hoteliers Association had objected to the NGT Order which had asked for closure of hotels flouting environmental laws and said that Section 39 of the Town and Country Planning Act, 1977 prescribes the procedure for non-compliance which has to pass a statutory provision. Apex Court disposes of the Appeal saying that "aforesaid provision is statutorily ingrained in the Town and Country Planning Act, 1977 the competent authority/Committee shall adhere to the said procedure".
