Judgement of the Bombay High Court in the matter of Unmesh Diwakar Raote Vs Municipal Corporation of Greater Mumbai & Others dated 13/07/2018 regarding unauthorized cutting of trees at Purandare Wadi, Gokhale Road, Mumbai. The petitioner (Unmesh Diwakar Raote) has challenged the Order passed by the Metropolitan Magistrate, Shindewadi, Dadar, Mumbai by which he came to be convicted of the offence punishable under Section 21 read with Section 8 of the Maharashtra (Urban Areas) Protection and Preservation of Trees Act, 1975 and is sentenced to suffer simple imprisonment for twenty days apart from directing him to pay fine of Rs.2,000/-.

Bombay High Court allows the Revision Petition of the Petitioner and said that the Order suffers from perversity as well as error on the point of law in "admitting inadmissible evidence on record" and the " petitioner/accused is acquitted of the offence punishable under Section 21 read with Section 8 of the Maharashtra (Urban Areas) Protection and Preservation of Trees Act, 1975".
