Order of the National Green Tribunal regarding discharge of untreated sewage in water bodies, Niwari town, Ghaziabad, Uttar Pradesh, 05/02/2019
Order of the National Green Tribunal in the matter of Vivek Tyagi Vs State of Uttar Pradesh & Others dated 05/02/2019 regarding failure to comply with the Solid Waste Management Rules, 2016 and taking steps to prevent discharge of untreated sewage in water bodies, including ponds and Upper Ganga Canal, endangering public health in Niwari town, 20 kms from Ghaziabad.
NGT orders the Urban Development Department to pay a sum of Rs. 25 lakhs for failure to manage municipal solid waste in accordance with the Rules and towards the damage to the environment already caused with liberty to recover the said amount from the erring officers/polluters. Further for failure to check untreated sewage being dumped into the water bodies, the Urban Development Department, would deposit further amount of Rs. 25 lakhs to compensate for damage to the environment and public health with liberty to recover the same from the polluters/erring officers. Tribunal suggests that instead of wasting time in preparing individual DPRs, the State may develop a model DPR to be replicated at other places. The State may also develop one or more model cities complying with the Rules so that such examples can be replicated at all other such places.
