Order of the National Green Tribunal regarding high level of noise pollution, Delhi, 14/03/2019
Order of the National Green Tribunal in the matter of Akhand Bharat Morcha Vs Union of India & Others dated 14/03/2019. The issue for consideration is the action against high level of noise pollution in violation of the Environment (Protection) Act, 1986 and the Noise Pollution (Regulation and Control) Rules, 2000 in Delhi. Action taken reports have been filed by the DCP (East), DCP (Shahdara) and DCP (South).
The Tribunal expresses its dissatisfaction with the action plans and said "If the law enforcers avoid their responsibilities, there will be no rule of law. The officers need to be made sensitive and given training about their duties. Action against only four persons and that too only on 11.03.2019 or simply writing to CPCB hardly meets the expectations when there is large scale violation of law. The NGT directs the Police Commissioner to monitor the working of concerned officers to safeguard the right of citizens. Court emphasised on the fact that the citizens have constitutional right to peaceful environment and noise pollution beyond prescribed norms is serious punishable crime for which adequate preventive and remedial action is needed. The Police Commissioner has been directed to end his report of monitoring in the matter within one month.
