Order of the National Green Tribunal regarding non compliance of environmental norms by M/s Lalitpur Power Generation Company Limited, Lalitpur, Uttar Pradesh, 24/05/2019
Order of the National Green Tribunal in the matter of Action for Vigilance and Knowledge for Empowerment Vs Lalitpur Power Generation Company Limited & Others dated 24/05/2019 regarding non compliance of environmental norms by M/s Lalitpur Power Generation Company Limited (LPGC), Lalitpur, Uttar Pradesh. Allegations in the application are that the LPGC is using fresh water in excess of permitted limit, not monitoring ambient air quality, not carrying out waste water treatment and is violating green belt plantation requirement around the plant. Report submitted by a joint committee pointed out deficencies related to fly ash disposal, installation of CAAQMS, handling hazardous waste, control of fugitive emissions, adequate tree plantation and proper operation of STP.
A report of joint inspection by UPPCB mentions the measurs adopted for compliance of the deficiencies. The NGT accepting the recommendations directs the industry to take remedial measures after drawing up an action plan for mitigation, especially ensure use of of latest technology instead of electro-static precipitators (ESP) for control of stack emissions. The Committee has been asked to examine the action plan and oversee the remedial action and assess the amount of compensation to be recovered on account of harm to the environment for the violations caused during the period of default. Further report of the action taken should be furnished by the joint committee within three months.
