Order of the National Green Tribunal regarding pollution in the course of four laning of National Highway from Udhampur to Banihal, Jammu and Kashmir, 11/07/2019
Order of the National Green Tribunal in the matter of Amresh Singh Vs Union of India & Others dated 11/07/2019 regarding pollution in the course of four laning of National Highway from Udhampur to Banihal in Jammu and Kashmir by the National Highway Authority of India (NHAI) through Gammon India Limited and the Hindustan Construction Co. Ltd.
NGT through its previous order dated 12/02/2019 had given directions to Gammon India and Hindustan Construction for payment of Rs. 1 crore each as interim compensation and to furnish performance guarantee in the like amount to the CPCB within one month. The NGT has been informed that the Court's directions have not been complied with. The two companies have been given a last opportunity for compliance. In the meanwhile, a report received from the State Pollution Control Board (SPCB) states that inspection conducted in respect of the dumping sites maintained by the Gammon India Ltd. as well as the Hindustan Construction Company Ltd. were found to be deficient. NGT said that even after after its order there has been default and the peformance guarantee of Rs. 1 crore each would be forfeited. In other words, M/s Gammon India Ltd. as well as M/s Hindustan Construction Company Ltd. are now required to pay a sum of Rs. 2 Crores each within one month from today.
