Order of the Supreme Court regarding parking space, 02/09/2019

Proper assessment of the parking needs and the requisite parking facilities for the next 25 years should be taken into consideration while granting permission to build any structures, the Supreme Court (SC) directed the Government of Delhi in its order of September 2, 2019. Further, the municipal corporations of Delhi have been asked to ensure that the pavements are cleared of all encroachments.

Order of the Supreme Court of India in the matter of M. C. Mehta Vs Union of India & Others dated 02/09/2019 regarding parking space.

There has been an "abject failure on the part of the government and the authorities to provide adequate public transport to the citizens of the country. Individual vehicles are owned by about 2% of the population. However, this 2% of the population wants to monopolise all the resources and infrastructure with regard to transportation" observed the apex court while passing the order on parking.

The following directions were issued by the SC:

1. All the municipal corporations along with the Delhi Cantonment Board have been asked to clear pavements of residential areas of all encroachments. This is to ensure that usage of pavements by pedestrians.

2. Notification of 'Draft rules of the Delhi Maintenance and Management of Parking Places Rules 2019' at the earliest. 3. Proper assessment of parking needs for the next 25 years should be done while granting permission to build any structures.

3. The Government of Delhi, the municipal authorities and Environment Pollution (Prevention & Control) Authority (EPCA) should take into consideration the "viability and effectiveness of introducing Radio-frequency identification (RIFD) tags, parking guidance and information systems and last mile connectivity from parking spaces to commercial areas, institutions" and submit a report.

4. EPCA has to submit a detailed report on the working of the pilot project started in Lajpat Nagar in April 2018. Further, EPCA has been asked to prepare pilot projects for Krishna Nagar and Kamla Nagar within two weeks and thereafter the pilot project would be introduced there.
