Order of the National Green Tribunal in the matter of Residents of Saren Phala Dhelana Vs State of Rajasthan dated 26/11/2019 regarding illegal marble mining at Saren Phala and Nichla Phala at Udaipur, Rajasthan.

This order is in continuation of the NGT order of May 2, 2019 on the subject of recovery of environmental compensation for illegal mining. The Tribunal found that assessment of compensation made earlier by the Rajasthan State Pollution Control Board (RSPCB) was erroneous ignoring the norms laid down by the Central Pollution Control Board (CPCB) as well as by the tribunal.

Report submitted by the RSPCB on determining environmental compensation was found unsatisfactory by the tribunal as it does not mention the area of mining, value of the mined material, financial capacity of the miner and extent of violations which are to be the basis for calculating the compensation. The Tribunal called for a further action taken report on the matter within two months.
