Order of the National Green Tribunal regarding pollution by Metallic Alloys, Raipur, Chhattisgarh, 14/05/2020

Order of the National Green Tribunal in the matter of Sudhir Versus State of Chhattisgarh dated 14/05/2020. The matter related to pollution being caused by M/s Metallic Alloys, Plot No. 29, Industrial Growth Centre, Sitara, Phase-III, Raipur, Chhattisgarh by using coke in the course of operation of furnace.

Two reports were filed in pursuance to the NGT order and they stated that coal was not being used and that as the unit was set up before September 14, 2006 EC was not necessary. It was further stated that the unit was not found operational being shut down for maintenance. The reports futher added that the furnace was operated by electricity. Bag filters had been installed with the heat exchanger to control pollution. The height of the chimney was 30 meters.

However, the applicant in O.A NO. 644/2019 has filed I.A No. 147/2020 to the effect that EC was required as consent to establish was granted in the year 2011 and the unit was set up thereafter and not earlier as mentioned in the two reports. It was also stated that pollution was being caused by the unit and requisite safeguards such as plantations etc. do not exist. There is illegal withdrawal of ground water also.

In view of the above facts, the NGT directed that a fresh report be furnished by a joint committee comprising of the Central Pollution Control Board, Ministry of Environment, Forest and Climate Change and Chhattisgarh Environment Conservation Board before August 31, 2020.
