Counter affidavit on behalf of the Pollution Control Committee, Daman and Diu and Dadra Nagar Haveli in the matter of M/s Platinum AAC Blocks Pvt. Ltd. Vs Pollution Control Committee & Others.
The matter related to Platinum AAC Blocks Pvt. Ltd. producing autoclaved aerated concrete blocks unauthorisedly at Kherdi, Dadra & Nagar Haveli at the cost of environment and human well being even after rejection of their proposal in June 2017. The Platinum AAC manufacturing unit had caused severe and serious environmental damages by dumping of fly ash raw material in entire premises and manufacturing of AAC blocks, without obtaining the prior consent to establish and operating the unit since June 2017. The unit needs to be closed to safeguard the environment and protecting the people from serious respiratory, renal and other illnesses.
The unit had violated the provisions of Water Act, 1974 and Air Act, 1981 and established the unit. The industry falls in red category and the report has recommended that such kind of unit, using huge quantities of fly ash pond as raw material should be established with in the locality of thermal power plants or near to a cement plant to avoid transportation by road. The unit was not manufacturing white category product and had false declarations that it would start to manufacture autoclaved aerated concrete (AAC) blocks in June 2019, whereas it was manufacturing the AAC blocks since June 2017.
