Order of the National Green Tribunal in the matter of Chandni Chemicals Pvt. Ltd. Vs Uttar Pradesh Pollution Control Board dated 04/01/2021.

The matter related to illegal storage of chromium waste by some of the industries in Kanpur, Uttar Pradesh.

The NGT noted that the Uttar Pradesh Pollution Control Board had failed to take action when the violation of environment norms had started and "for 14 years after the companies claim to have been closed".  The chromium dump at Kanpur Dehat is continuing to cause damage to the environment and the public health. The persons responsible for dumping hazardous waste, which has contaminated the groundwater to the detriment of the inhabitants, cannot disown responsibility for liability for such damage on the ground of inaction of the authorities or closing of the companies, the NGT order of January 4, 2021 said. The UPPCB was directed to determine the industries liability within a period of three months and till that was done, further coercive actions must not be taken.
