Order of the High Court of Delhi in the matter of Tata Motors Ltd Vs Government of NCT of Delhi & Others dated 10/03/2021.
The matter related to electric vehicle subsidy for Tata Nexon EV. An appeal was filed in the Delhi High Court against the impugned order of March 1, 2021 passed by the Deputy Commissioner (OP-I), Government of NCT of Delhi- whereby by way of an interim order, Tata Nexon EV was suspended as an eligible electric vehicle from the list of eligible models for availing subsidy under the Delhi Electric Vehicle policy.
The bench of Justice Sanjeev Sachdeva of the High Court of Delhi stayed the impugned order to the extent that suspension was lifted for listing Tata Nexon EV as an eligible EV from the list of eligible models from availing subsidy under the Delhi EV Policy. Without there being any material to substantiate allegations, the Deputy Commissioner (OP-I), Government of NCT of Delhi directed de-listing of Tata Nexon EV as an eligible vehicle for availing subsidy under Delhi Electric Vehicle policy, the Delhi High Court said.
The impugned order was contrary to the policy of the government and defeat the very purpose of the scheme of the Policy of Faster Adoption and Manufacturing of Hybrid and Electric Vehicles. The vehicle of the Tata Motors met the criteria laid down by the Delhi Electric Vehicle policy and was also certified by the Statutory Testing Agency ARAI, the order said.
