Order of the National Green Tribunal in the matter of Mahesh Chandra Saxena Vs The Chief Secretary, Govt. of NCT of Delhi & Others dated 07/07/2021.
The matter related to rainwater harvesting systems in Dwarka.
The applicant has sought for inspection of all the rainwater harvesting systems constructed in all societies of Dwarka by a team comprising of Ground Water Cell of Delhi Jal Board, Member from Central Pollution Control Board and the applicant (Mahesh Chandra Saxena) for collection and sending of samples for examination in the lab.
According to the applicant he has conducted survey of rain water harvesting systems of 40 societies in Dwarka and found deficiencies - the borewells are deeper, enabling polluted water to mix with the groundwater.
The NGT directed a joint Committee of Delhi Jal Board (DJB), the Central Pollution Control Board (CPCB) and the Delhi Pollution Control Committee (DPCC) to look into the matter and take remedial action in the matter in accordance with law. The Committee would also ascertain the technical efficacy of installed systems and changes, if any, required and the issue of contamination of ground water. An action taken report has to be furnished within two months and the DJB would be the nodal agency for coordination and compliance.
