Order of the National Green Tribunal in the matter of Confederation of Trans Hindan RWA’s Ghaziabad Vs Uttar Pradesh State Pollution Control Board & Others dated 22/10/2021.

The matter related to management of waste at Indirapuram, Vasundhara and Vaishali, Ghaziabad, Uttar Pradesh. The bench of Justice Adarsh Kumar Goel, Sudhir Agarwal and Brijesh Sethi said that this case was another instance of "disappointing performance of statutory authorities in scientifically managing the waste" and this inspite of continuous monitoring by the Tribunal for the last three years. The application was filed by the Resident Welfare Associations on the failure of the statutory authorities to manage the waste.

The NGT, October 22, 2021 directed the Chief Secretary, Uttar Pradesh to take the assistance of Additional Chief Secretary, Nagar Vikas, Uttar Pradesh and any other authorities to review the situation within one month. Pending assessment quantification of compensation, the Ghaziabad Nagar Nigam may deposit interim compensation of Rs. 1 crore with the CPCB within 15 days, to be utilised for restoration of the environment. The Nigam is free to recover the amount out of the salary of erring officers, the NGT order said. Further, the court has asked the Central Pollution Control Board (CPCB) to give an independent report on the issue of management of solid as well as liquid waste in the area in question before February 24, 2022. The report would mention the area of both the legacy sites reclaimed, quantity of waste bio-mined, routing of recovered material for further usage.
