Order of the National Green Tribunal in the matter of Bhanwar Lal Bhargava Vs State of Rajasthan dated 06/01/2022.
Issue for consideration is remedial action against discharge of untreated sewage and industrial effluents on the agriculture lands at village Nokha, District Bikaner, Rajasthan. The matter has been considered by the Tribunal in the last more than two years by several orders and the court had found failure of the state authorities in ensuring compliance of Supreme Court order (Paryavaran Suraksha case) resulting in continuing water pollution.
The NGT expressed surprise at the repeated plea of the Rajasthan government of lack of funds resulting in continuing water pollution and non-compliance with the provision of the Water Act and the directions of the SC requiring waste water treatment plans to be positively in place by March 31, 2018 - failing which prosecution of erring authorities must be initiated.
The NGT, January 6, 2022 directed the current and incoming Chief Secretaries, Rajasthan to take immediate remedial measures and compliance of the NGT order, September 21, 2021 in coordination with concerned officers and file a report of compliance within two months.
