Order of the National Green Tribunal in the matter of Mahagunpuram Apartment Owners Association Vs Ghaziabad Development Authority & Others dated 25/03/2022.
The application was filed to consider the compliance report filed by the Ghaziabad Development Authority (GDA) in pursuance of the NGT order, August 20, 2018 (O.A. No. 06/2018).
The NGT had directed the Ghaziabad Development Authority to comply with environmental clearance - the housing societies are required to keep 15 per cent o the area as green belt out of the total plot area of 54630 sq. metres.
The matter was last considered by the court, February 3, 2022 in the light of the compliance report filed by the SPCB, acknowledging the continued violation for which environmental compensation of Rs. 14 crores was assessed against the project proponent.
The Ghaziabad Development Authority failed to ensure compliance of environment clearance conditions. Further, the order of the Uttar Pradesh Pollution Control Board for the payment of compensation and taking further measures has also not been complied with, the court said. The NGT directed the SPCB and the GDA to ensure compliance of directions already issued, taking coercive measures as necessary and a compliance report to be filed.
