Order of the Supreme Court of India regarding constitution of a Pennaiyar Water Disputes Tribunal, 14/12/2022
Order of the Supreme Court of India in the matter of the State of Tamil Nadu Vs the State of Karnataka & Others dated 14/12/2022.
The SC granted three months time to the Central Government to complete the process of constituting the Pennaiyar Water Disputes Tribunal to resolve the dispute between the states of Karnataka and Tamil Nadu. The Supreme Court, November 16, 2022 had pulled up the Union of India for the delay in resolving the dispute between Tamil Nadu and Karnataka over the sharing of Pennaiyar water.
The Union of India had sought six months time to constitute the Tribunal and said that a "proposal for information of Pennaiyar Water Dispute Tribunal" has to be approved by the concerned minister and after that a cabinet note has to be prepared.
The cabinet note will seek approval for constitution of the Tribunal and also for the creation of posts (chairman and assessors).
After approval of cabinet note, then it will be circulated to the Ministry of Home Affairs, Law and Justice, Finance and the Prime Minister's officer for their comments and observations - which will also be incorporated in the cabinet note.Thereafter "legal vetting is to be done by the Ministry of Law and Justice" and then gazette notification will be issued.
