Order of the National Green Tribunal regarding violation of environmental norms by a petrol pump, village Ajabpurkala Mata Mandi road, Dehradun, Uttarakhand, 20/02/2023
Order of the National Green Tribunal in the matter of Amit Agrawal Vs State of Uttarakhand dated 20/02/2023.
The grievance is that there is a petrol pump installed in the residential area in violation of siting criteria and causing other violations of environmental norms and loss causing damage to environment but no action has been taken by the authorities in the matter. The said petrol pump is located at khasra no. 68, village Ajabpurkala Mata Mandi road, Dehradun, Uttarakhand which is a residential area. On both sides of the petrol pump requisite setbacks have not been left, fire extinguishers have not been installed. Fire safety measures have been violated. Further clearance from the Fire Department has not been obtained and the requirement of 18 metre width road is also not complied with.
A joint committee comprising the Uttarakhand Pollution Control Board and the District Magistrate, Dehradun was directed by the NGT to look into the complaint, visit the site, and collect relevant information. If any violation of environmental norms is found, the authorities will take appropriate remedial action - in terms of having preparation of on and off site crises management plan and complying requirement of maintaining isolated storages as per Manufacture Storage and Import of Hazardous Chemical (MSIHC) Rules, 1989 in accordance with law within two months.
