Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Amendment Rules, 2023
The Central Government has notified the Information Technology (Intermediary Guideline and Digital Media Ethics Code) Amendment Rules, 2023. This notification was issued on 6th April, 2023 and are effective from that same date. These Amendment Rules amend the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. They have now incorporated provisions relating to online gaming. The Amendment Rules have inserted a definition for “online game‟. Online game is defined as a game that is offered on the Internet and is accessible by a user through a computer resource or an intermediary. Additionally, these Amendment Rules have also now incorporated the following definitions: online gaming intermediary, online gaming self-regulatory body, online real money game, permissible online game, permissible online real money game. The Rules also provide that an online gaming intermediary who enables the users to access any permissible online real money game shall inform its users of such change as soon as possible, but not later than twenty-four hours after the change is effected. He shall also display a demonstrable and visible mark of verification of such online game by an online gaming self-regulatory body on such permissible online real money game.
