Order of the National Green Tribunal regarding discharge of untreated sewage and effluent by a residential society in Gurugram, Haryana, 08/12/2023
Order of the National Green Tribunal in the matter of Chairman Legal Committee Esencia Residents Welfare Association Vs State of Haryana dated 08/12/2023.
The original application was registered on the basis of a letter petition dated March 31, 2023 sent by Esencia Residents Welfare Association, Sector-67, Gurugram, Haryana. According to the complaint there is a residential society namely Ansal Esencia and Ansal Versilia, Sector 67, Gurugram where untreated sewage water and effluent is being discharged illegally at the surface area near residents buildings, roads of the subject premises, vacant plots, sites meant for hospitals, schools, clubs etc. In fact, no sewage/effluent treatment plant was constructed as per the terms of the environmental clearance and before construction of treatment plant, occupancy certificate was issued to the builders, as a result whereof, occupancy has been allowed and environmental laws are being violated.
By court order dated May 30, 2023 a joint committee was constituted and a report submitted, October 13, 2023.
The report verified non-compliance of environmental laws and norms on the part of the developer and also stated that an environmental compensation of Rs. 3,40,50,000/- for not obtaining consent to operate also and for discharging untreated effluent/sewage on the open land, has been recommended by Haryana State Pollution Control Board vide vide letter dated September 25, 2023. Despite the order being passed two and a half months back, no final order has been passed till date the court noted.
The NGT, December 8 directed notice to be issued to state of Haryana, Haryana State Pollution Control Board, District Magistrate, Gurugram and M/s. Ansal Properties & Infrastructure Ltd. All the respondents have been directed to file their reply within four weeks and the court listed the matter for February 8, 2024.
