Order of the National Green Tribunal regarding illegal sand mining in Yamuna Khadar area, village Nangalarai, Muzaffarnagar, Uttar Pradesh, 13/02/2024

Order of the National Green Tribunal in the matter of News Item titled "Nanglarai khanan dhekedar Bandhuyo ke kheelaf gramino ne khola morcha" appearing in Sach Kahun dated 29.12.2023 dated 13/02/2024.

The application was registered suo motu on the basis of a news item that said that illegal sand mining was going on in Yamuna Khadar area of village Nanglarai and the flow of the river has been affected due to the construction of a sand bund. The news item further reveals that on account of sand mining, pits upto the depth of 30 feet have been created and on account of the overloaded vehicles transporting the sand, crops of the nearby agricultural fields are destroyed and the bund, created to prevent flooding in the nearby inhabited area, has been destroyed by the trucks transporting the sand which has created a danger of flooding of the area during rains.

The NGT directed notices to be issued to the Uttar Pradesh Pollution Control Board; Collector and District Magistrate, Muzaffarnagar; Regional Officer, MoEF&CC, Lucknow and Central Pollution Control Board (CPCB). All the above mentioned respondents have been directed to file their reply at least one week before the next date of hearing, April 24.

The tribunal also directed the constitution of a joint committee. The joint committee will visit the site, ascertain the true state of affairs there and extent of illegal mining and persons responsible for the same and submit the status report.
