Order of the National Green Tribunal (Eastern Zone Bench, Kolkata) in the matter of Ram Gayan & Others Vs State of West Bengal & Others dated 21/03/2024.
The matter related to filling up of a pond in village Uchheypota, District South 24 Parganas, West Bengal. The pond is being filled up with soil using dumpers and construction is going on on this pond for the purpose of buildings and boundary walls.
The NGT directed impleading Principal Secretary, Department of Environment, West Bengal; Member Secretary, West Bengal Pollution Control Board; Collector and District Magistrate, South 24 Parganas as well as two individuals alleged to be filling up the pond. All the respondents have been directed to file their counter-affidavits within four weeks.
The eastern bench of the NGT also directed constitution of a fact finding committee to enquire into the allegations made in the complaint comprising a senior scientist, West Bengal Pollution Control Board and Collector and District Magistrate, South 24 Parganas. The committee would visit the sites in question and conduct an inspection with respect to the allegations made and submit its report on affidavit within four weeks.
