Order of the National Green Tribunal (Central Zone Bench, Bhopal) in the matter of Mukesh Kumar Gurjar & Others Vs State of Rajasthan & Others dated 06/03/2025.

The issue raised in the application is illegal operation of mining of Cheja Pathar unit at village Beri Bandh, tehsil Paota, district Kotputli Behror, Rajasthan. According to the applicant, the project proponent is involved in mining of cheja pathar (masonry stone) in violation of environmental norms as well as consent conditions. The area is also adjoining the abadi area of village Beri Bandh, where the project proponent is encroaching the land initially allotted for excavation, beyond the lease area.

The respondents which included the state of Rajasthan through its Principal Secretary (Mines); Rajasthan State Pollution Control Board; Department of Mines and Geology, Jaipur region; State Environmental Impact Assessment Authority (SEIAA) Rajasthan among others was directed by the central bench of the NGT to submit their reply.

The court also directed the constitution of a joint committee consisting of one representative from the District Collector, Kotputli, Behror and one representative from the Rajasthan State Pollution Control Board. The two member committee has been directed to visit the site and submit the factual and action taken report within six weeks.
