Order of the National Green Tribunal (Central Zone Bench, Bhopal) in the matter of Rajendra Tiwari Vs Union of India & Others dated 06/03/2025.
The matter related to encroachment of the forest land. The contention of the applicant was that the land situated in village Bassi Sitarampura is reserved forest land. Private respondents have encroached upon vacant portion of reserved forest land. Respondents have not obtained the prior consent to establish and consent to operate under the provisions of the Water Act 1974 and Air Act 1981. The applicant also raised the question of source of water for the construction already raised. Construction is being raised in the absence of consents under the provisions of Water Act, 1974 and Air Act, 1981.
The tribunal directed the constitution of a joint committee to visit the site and submit the factual and action taken report.
