Order of the Supreme Court in the matter of State of Rajasthan & Others Vs Ashok Malik & Others dated 17/03/2025.
The SC accepted the statement made in the affidavit by the Chief Secretary, state of Rajasthan to relocate the structures inside the Seven Wonders Park along the Ana Sagar Lake in Ajmer within a period six months.
"The statement on oath clearly shows that even the State is aware that the structures were constructed on a lake because a prayer is made in the alternative to permit the structures to remain at the same place without disturbing the ecology of the lake or the environment in the area," observed the bench of Justice Abhay S Oka and Justice Ujjal Bhuyan.
The apex court granted time of six months to the state to remove the structures.
The SC also accepted the assurance recorded in the affidavit that the entire food court will be removed. If the state wants to maintain the work done on the wetland or lake, the state should come out with a proposal to recreate the wetland in the same city of the adequate area, the SC directed. To enable the Rajasthan government to come out with the proposal, the SC listed the matter on April 7, 2025.
