Order of the National Green Tribunal in the matter of Akhilesh Kumar Vs State of Uttar Pradesh & Others dated 23/05/2025.
The matter related to illegal mining activites carried out by Jai Maa Chandrika Enterprises, Rajendra Nagar, village Kabari, district Mahoba, Uttar Pradesh. The applicant also alleged about illegal sale and use of ammonium nitrate to the miner.
The plea of the applicant is that the gatta number 576 at village Leta, tehsil Kulpahad, district Mahoba, Uttar Pradesh was allotted to the miner for 10 years with effect from May 24, 2001 and the 10 years has expired. Even then Jai Maa Chandrika Enterprises has sought license for ammonium nitrate fuel oil (ANFO) shed for manufacturing of ANFO.
for the applicant has referred to the RTI information, March 30, 2024 by which it was informed that the Araji No 576 area covering 4.50 acres was sanctioned to the miner to 10 years with effect from May 24, 2001. The applicant also referred to the RTI information dated April 25, 2024 supplied by the Directorate General of Mines Safety informing that no notice of opening of mine in Gatta No. 576, village Leta, tehsil Kulpahad, district Mahoba, Uttar Pradesh has been given to the Directorate. Jai Maa Chandrika Enterprises is indulging in illegal mining by the unauthorized and illegal use of the ammonium nitrate, the applicant said.
The NGT said that the matter raised substantial issue relating to compliance of environmental norms. The court directed notice be issued to the Controller of Explosives; Uttar Pradesh Pollution Control Board; Jai Maa Chandrika Enterprises and District Collector Mahoba. The court will next hear the case of September 1, 2025.
