Experts hold the key

In the Pratap Pharma versus Union of India case, the Supreme Court has held that the Union Government cannot exercise its power to ban or prohibit drugs or injections of the Ayurvedic, siddha or unani systems unless proved by an expert body under the Drugs and Narcotics Act, 1949. The body has to state that such drugs or injectables are unfit for human or animal consumption and that they do not conform to the prescribed standards. While directing the expert body under the Act to examine and then certify whether the drugs are meeting the specified standards and are fit for consumption, the judgement has continued the stay on the ban and permitted the manufacture and sale of such drugs.
