Bench orders probe into violation of coastal laws

Authority directed to settle dispute within three months Licensee not authorised to build in CRZ: INTACH Division bench dubs INTACH petition infructuous MADURAI: The Madras High Court Bench here has directed the Kanyakumari District Coastal Zone Management Authority to probe into allegations of constructions being put up within 100 m of the coast in Kanyakumari town panchayat. Disposing of two writ petitions, a Division Bench of Justices V. Ramasubramanian and D. Hariparanthaman directed the Collector to ensure that the character of the land was not altered until completion of the probe. The Indian National Trust for Art and Cultural Heritage (INTACH) had filed one of the writ petitions challenging permission granted by the Collector and Executive Officer of the town panchayat to a licensee to maintain two parks near the coast. The Trust claimed that the licensee was not authorised to construct buildings in the area, which fell under Coastal Regulation Zone (CRZ)-I. Admitting the petition, the High Court on May 7, 2008 ordered status quo. The same day, the then Collector, B. Jothi Nirmala, found fault with the licence granted by her predecessor and revoked it. The licensee challenged the revocation in the Bench and obtained an interim stay on June 18 last year. Taking up both writ petitions together, the Division Bench, headed by Mr. Justice Ramasubramanian, closed INTACH
