Consumer body admits Rs 640cr suit against Nestle

The country's apex consumer dispute re dressal commission NCDRC, on Monday admit ted the Centre's complain against Nestle India seeking Rs 640 crore for its alleged unfair trade and deceptive practices pertaining to Maggi instant noodles. Issuing notice to Nestle, the commission directed it to respond by September 30 (the next date for hearing) and also asked the government to send samples of Maggi noodles to an accredited laboratory for tests on lead content and MSG.
A bench of NCDRC headed by Justice V K Jain and member B C Mehta also took note of the recent Bombay high court order quashing the ban by food regulator for manufacturing and selling of nine variants of instant noodles in the country . “high court has quashed your (Centre's) order on the ground that laboratory were not accredited and recognized....Second, you did not follow correct procedure...As on today , what fresh material do you have to show as the earlier has been rejected by the high court,“ the bench said.
The counsel of consumer affairs ministry informed the commission that even Bombay HC has noted that Maggi Masala Oats noodles doesn't have the product approval from the food regulator, FSSAI, and how it has asked Nestle to seek approval. The other argument was that by claiming “no MSG added“ Nestle indulged in misrepresentation because it's as good as claiming there is no MSG. But this is not the case.
“The court has sought fresh, sealed samples to be tested by accredited labs. Further course of action will be decided by the ministry (of consumer affairs),“ additional solicitor general Sanjay Jain said after the preliminary hearing.
