Court orders collection of water samples from Noyyal

CHENNAI: The Madras High Court on Monday said a member of the court Registry would collect water samples from the Noyyal river in the presence of the residents of Athupalayam village in Karur district.
The First Bench comprising Chief Justice M.Y.Eqbal and Justice T.S.Sivagnanam passed the interim order while adjourning to October 21 a contempt petition. The Bench said that in the meanwhile one of the members of the Registry would visit the place in question on October 20 and collect the samples. In a contempt petition, the Noyyal River Ayacutdars Protection Association, Athupalayam, represented by its president, A.P.Kandasamy, sought to punish the authorities for wilful disobedience of the High Court orders of April 2008 on a PIL petition.
The petitioner submitted that a Division Bench in April 2008 had directed the Pollution Control Board to take appropriate steps to remove the excess production machinery in the dyeing and bleaching units in and around Tirupur by making due inspection of the units with the assistance of a High Court-appointed monitoring committee. It was also ordered to submit its action taken report (ATR) by July 31, 2008. But the report was not submitted.
The petitioner filed an application in this regard. Only thereafter and that too after the High Court's direction, did the Board, instead of filing the ATR, file a counter affidavit in March this year. The authorities did not take any steps to remove the excess machinery in the dyeing units.
To an RTI query, the District Environmental Engineer, Tirupur, furnished a reply and also communication to the Board with a report containing the details about the excess machinery in the dyeing and bleaching units in Tirupur for taking necessary action.
Despite the report, the Board had not taken any action. Hence, the present contempt petition.
The petitioner also said that the monitoring panel in its report in February this year had stated that during its inspection in December 2009 had it found that many units in Tirupur had reinstalled excess machinery.
