HC: Formulate bore, tube well policy

PANJIM: The High Court of Bombay at Goa, in a public interest litigation, has ordered that the policy on digging of bore wells, tube wells and controlling of activities of water tankers be formulated by April 30, 2014 and implemented from May 1, 2014. A draft policy has already been framed by the State Government. “We make it clear that the policy shall be formulated in any case by the end of 30.04.2014 and shall be implemented from 01.05.2014,’ says the order by Justice F M Reis, and Justice B R Gavai in the order dated Nov ember 26 which also says: “We further make it clear that the Chief Engineer shall give an opportunity to the petitioner of being heard and hear his suggestions on the policy.” The petitioner has approached this Court regarding the uncontrolled extraction of ground water and non formulation of policy by the State regarding the digging of bore wells, tube wells etc., and non controlling the activities of the water tankers. Rodrigues, the Addl Government Advocate said that in pursuance of the order passed by this Court in Public Interest Litigation No. 18 of 2012 dated 26.03.2013, a draft policy has already been framed by the Government and that the period for finalizing the policy granted by this Court ends in April, 2014. The court ordered that in that view of the matter, “we find it appropriate that the State Government should give wider publication to the draft policy and invite objections from the public at large so that the wider policy can be framed after taking into consideration the objections raised by the public.
