HC verdict on river islet constructions on Feb 27

Cuttack: The Odisha High Court has completed hearing on a PIL that has challenged the alleged unauthorised constructions on the Mahanadi islet at Hadiapatha here for the purpose of an intake well that would facilitate supply of water for the Indian Oil Corporation’s (IOC) oil refinery in Paradip. The Division Bench of Chief Justice V Gopala Gowda and Justice BN Mohapatra, which has been adjudicating over the PIL since November last year, however, reserved its order that is likely to be pronounced on February 27, informed petitioner-advocate Nishikant Mishra.
On the concluding day of the hearing, water resources secretary Suresh Mohapatra and the engineer-in-chief of the department appeared before the Bench and submitted affidavits stating the government’s stand on the matter.
Apprehending that the constructions in the islet would increase flood-threat to Cuttack city, Mishra, on behalf of his organisation Nationalist Lawyers’ Forum, has filed the PIL.
Stalling the constructions in the islet by slapping an interim stay on it, the High Court had constituted a committee of experts asking it to submit a report after examining all aspects.
In the meantime, the panel comprising former engineers of the irrigation department, in its report, has reportedly maintained that the apprehensions of the petitioner are unfounded. The panel, however, made certain suggestions on the issue which are likely to be reflected in the final verdict of the High Court.
