Health Service DG sued for promoting substandard drugs

A drug manufacturer and distributor has filed an application by way of a public interest litigation seeking a direction from the Supreme Court the Bribery Commission to initiate an investigation against Director General of Health Services for promoting substandard drugs and allegedly accumulating wealth. The petitioner Arushan Raninkumar of Hillside Tea and Pharmaceuticals Suppliers (Pvt) Limited in his petition said Dr. Ajith Mendis, Director General of Health Services of Ministry of Health has allegedly acquired wealth the value of which could not be reasonably justified by his known income. The petitioner claimed he is also a private investigator and he has forwarded the information he has found to the Commission to Investigate into Allegations of Bribery and Corruption. He claimed that he was the importer of certain drugs to the government hospitals from Madras Pharmaceuticals in Chennai with his partner V. Nadaraja who later separated from him. Having found some of the drugs imported from the said company to be substandard he has ceased purchasing. But V. Nadaraja took over the importation. Raninkumar complained that he disclosed of corruptive malpractices committed by Director General of Health Services and Nadaraja to the Bribery Commission. He said that there were instances where Nadaraja has allegedly imported substandard drugs to the government hospitals but Director General has continued to award tendered to Nadaraja. Raninkumar claimed according to his findings both respondents have amassed massive wealth. He stated that there were payments made to Dr. Ajith Mendis by Nadaraja with cheques. He asked court to issue a writ order on the Bribery Commission to initiate an investigation against the respondent. He also asked the Court to issue a writ directing the Commission to issue a notice on the Commissioner General of Inland Revenue to furnish information regarding Nadaraja.
