Issue fresh consent order: HC to TNPCB

The Madras High Court on Tuesday observed that the Tamil Nadu Pollution Control Board (TNPCB) has not applied its mind while giving the consent order for the operation of the controversial Koodankulam Nuclear Power Project (KNPP) and directed it to submit a fresh consent order on Thursday. A division bench of Justices P Jyothimani and P Devadoss issued the directive during the hearing of a petition by an NGO which sought a direction to the TNPCB’s Member-Secretary to personally inspect the KNPP with a team of experts and then issue the consent order. Justice Jyothimani said, “You say 45 degree C at the point of discharge (effluent). It is wrong. It is a nuclear power plant. That shows PCB has not applied its mind at all.”
The TNPCB in its July 23 consent order given to KNPP had fixed the tolerance temperature limit of trade effluent of KNPP at the point of discharge at 45 degree C.
After the judge’s direction, TNPCB submitted that a fresh order would be filed on Thursday.
