The Kerala High Court on Tuesday made it clear that without technical study report it may not be correct to limit the extraction of groundwater by soft-drink major Pepsi.
The order was issued by a division bench comprising Acting Chief Justice Mr C N Ramachandran Nair and Justice Mr P S Gopinathan while disposing of a writ appeal by the Government.
The Government had filed the appeal challenging the direction of single judge permitting Pepsico India Holdings Private Ltd to extract six-lakh litres of ground water per day for its plant in Palakkad district.
According to the Government, indiscriminate extraction of ground water will cause severe environmental impact, besides leading to shortage of drinking water.
Advocate General Mr K P Dhandapani informed the court that technical study would be arranged at the earliest.
The Bench said study report of technical committee was required for final disposal of the case and directed the State Government to constitute a committee. As soon as the report was ready, the case should be considered by the single judge, the court held.
The single judge has been directed by the Bench to dispose of the writ petition within three months of submission of study report.
