"There can be no question of any mala fide, so far as Iam concerned in issuing the amendment to the coastal regulations, which are legislative and statutory in charater," Union Minister of Environment and Forests T R Baalu said in his counter-affidavit filed in the Madras High Court. The Tamil Nadu Government, perhaps, finding no legal and constitutional flaws or other infirmities in notification, had made a deliberate as well as a desperate attempt through its Chennai Metropolitan Development Authority member-secretary to project a case of malafide, the counter filed in response to a writ petition from the CMDA challenging the notification dated April 22, 2003, said.
