SC dismisses PRP Exports' plea to operate quarries in Tamil Nadu

PRP Exports is currently facing charges of illegal quary operations in Tamil Nadu The Supreme Court has dismissed a Special Leave Petition filed by PRP Exports, the granite company which is facing charges of illegal quarry operations in Tamil Nadu, seeking the apex court to allow the company to operate the quarries in accordance with the licenses already granted. The petition was against an order passed by the division bench of Madras High court restraining the operations of the company, reversing an earlier judgement of a single Judge in the Madras High Court which allowed the company to continue the operations. The Supreme Court, in an order issued on December 13, 2013, observed that several writ petitions are pending consideration before the High Court and it would not be appropriate to pronounce upon the various contentions raised by both the company and the government on merits of the case at this stage, especially in the light of the materials leading to the issuance of the suspension orders dated December 14, 2012 and the show cause notices in December 2012. "We also notice that the Division Bench of the High Court has issued some equitable directions taking into consideration the interest of the workers and also for honouring some statutory obligations of the petitioner firm. We, therefore, find no reason to interfere with the impugned judgment dated 15.2.2013 and the special leave petitions filed against those orders stand dismissed," said the order by Justice K S Radhakrishnan and Justice A K Sikri. Earlier, the government said that it has been receiving various complaints and started investigating the issue of illegal quarrying. Alleging that the PRP Exports had indulged in unauthorized quarrying, the State government officials as well as the District Collector and Superintendent of Police took steps to seal its factory premises, vehicles and instruments to suspend the quarrying operations in the quarries. Following a scientific survey, the Deputy Director and the Assistant Director of Geology and Mining submitted an Evaluation Report on November 23, 2012 on 88 granite quarries. Among them, 16 quarries belonged to the company. The inspection could not be carried out in 22 granite quarries due to water logging and among that 18 quarries belonged to PRP Exports.
