SC imposes fine of Rs. 50,000 each on two hoteliers

The Supreme Court yesterday (2) imposed a fine of Rs. 50,000 each on two hoteliers for making noise using amplifiers violating the sound pollution guidelines. The Bench comprising Chief Justice, Sarath N. Silva, Justices, Andrew Somawansa and Jagath Balapatabendi imposed the fines on the owners of Randiya Hotel, Moratuwa, Michael Mendis and Sheran Nonis and discharged them. Court had already granted a cash bail of Rs. 100,000 each for two hoteliers who had violated the sound pollution guidelines by using loudspeakers and for the band in their hotel. Following complaints by the residents around the hotel, the Supreme Court had earlier warned the owners of the hotel. Later on a complaint to the Moratuwa police the owners were produced before the Moratuwa Magistrate and granted bail. The court was given copies of a report compiled by the Environmental Foundation Ltd. (EFL) on sound pollution yesterday. The report consisted of the results of monitoring carried out by EFL during the months of April and May (since the last court date on April 4). EFL monitored the cities of Colombo, Kandy, Kurunegala and Galle. The Police were asked to take action regarding the complaints. The court stressed the importance of public awareness on the issue of noise pollution. The court directed the National Lotteries Board to make necessary arrangements to ask lottery vendors to minimise noise from loudspeakers. EFL's recommendation on the removal of loudspeakers situated outside the premises was endorsed and Police were asked to take the necessary action. The issue of the noise from the exhausts of buses to be addressed through the National Transport Commission, and Police to take action on the recommendations made by EFL. President's Counsel, Nihal Jayamanne with Dilan de Silva instructed by Paul Ratnayake Associates appeared for the hoteliers.
