The Supreme Court Thursday held that no public will be entitled to file a public interest ligitation (PIL) in the matter concerning the sharing of water of any inter-state river and justified the construction of the hydro-electric project at Rajolibanda in Raichur district by the Karnataka government. While dismissing a PIL filed by Atma Linga Reddy and others from Andhra Pradesh, a bench headed by Justice C K Thakkar said, "The petition under Article 32 of the Constitution is not maintainable and is liable to be dismissed, no further action is called for.'' Party to disputes While reading out the operative part of the judgement, the Judge said the states should be the party in a river water disputes. A group of farmers from Andhra Pradesh had filed the public suit before the Apex Court in 2005 seeking direction to the Karnataka government to ensure enough flow of water from the Rajolibanda Diversion Scheme (RDS) on the Tungabhadra, a tributary of Krishna, in Raichur District. Directions sought The petition sought directions to Karnataka to regulate water at Rajolibanda Diversion Scheme anicut and to ensure smooth flow of water in the RDS canal to the extent of full allocated water of 15.9 TMC to the state of Andhra Pradesh. The petitioners, who are the farmers from the Mahboobnagar district in AP, had pleaded that their crops would be affected if there was no sufficient supply of water to their districts.
