SEZs have already been denotified by people, asserts Rajya Sabha MP

The three special economic zones in Goa notified under Special Economic Zone Act 2005 have already been denotified by the people of Goa and therefore a bureaucratic order is meaningless and impractical, said Rajya Sabha Member of Parliament, Shantaram Naik. Reacting to the refusal by the Union Commerce Ministry to de-notify the three special economic zones, Naik said that he had no doubt that the State government will not leave the issue in wilderness and fight the battle in the interest of the people and the State. .Naik said that on January 3, 2008, a delegation led by the Chief Minister of Goa Digambar Kamat, which also included, Chief Secretary J.P.Singh and himself, had called on Union Commerce Minister Kamal Nath in New Delhi. In the said meeting, also attended by joint secretary of Commerce Ministry Pillai, Kamal Nath had assured the delegation that no SEZ will be thrust on the State. Naik further said that the commerce minister was fully sympathetic towards the stand taken by the Goa government and had remarked that no SEZ can function if the State government and its people are against it, and that, therefore, ground realities are relevant in such matters. Naik said that the commerce minister, who was very clear that there was no legal hurdle on the way of de-notifying the notified special economic zones, had clearly indicated that he will soon do so. However, he said that it appears that some officials in the ministry have not correctly advised Nath in this regard. .Naik said that an authority which has power to issue a notification has inherent power to rescind it, and that no specific provision is required for the purpose. Quoting Section 21 of General Clause Act 1897,. Naik says that the said section says, "Where, by any Central Act or Regulation, a power to issue notifications, orders, rules, or bye-laws is conferred, then that power includes a power, exercisable in the like manner and subject to the like sanction and conditions if any, to add to, amend, very or rescind any notifications, orders, rules or bye-laws so issued, Naik said.
