Order of the National Green Tribunal in the matter of Capt. Mall Singh & Ors. Vs. State of Punjab & Ors. dated 06/09/2017 regarding waste to energy plant in Bathinda, Punjab. Counsel appearing for the State of Punjab has submitted before the Tribunal that the solid waste management plant is functioning satisfactorily. He also pointed out that the Project Proponent is not starting the waste to energy plant in accordance with the terms of contract and that the Refuse Derived Fuel (RDF) which generated is not being accepted by the end user.

The Project Proponent informed the Tribunal that if the State Government of Punjab provides fair terms then it is willing to establish waste to energy plant.

NGT directs that the RDF produced by the Project Proponent be provided to the Central Pollution Control Board, Punjab State Pollution Control Board and Punjab Engineering College, Chandigarh for testing. Further the RDF will be analysed with reference to critical parameters like calorific value, moisture content, inert, etc. and report thereof, be submitted to the Tribunal. The Tribunal also directed the Project Proponent to seek instructions as to establishment of waste to energy plant, by using most modern technology, which would not result in unhealthy or environmentally hazardous emissions released in the surrounding areas.
